How To Effectively Resolve A Dispute

During a tenancy, it is not uncommon for disagreements between landlords and tenants to arise. Luckily, the Residential Tenancies Act outlines what you have to do to solve these matters quickly and efficiently.

The Residential Tenancies Act provides information on the rights and responsibilities that both landlords and tenants have while renting residential properties. The Act covers both parties during the duration of a tenancy and sets out rules that must be followed to ensure they are on the same page at all times. 

In the case that a disagreement arises, here is what you need to know about the stages of filing a complaint.

Before Filing A Formal Complaint

Before proceeding, you must first let your landlord or tenant know about your concern. After you have addressed your concerns:

  1. Check the Residential Tenancies Act to see if your concern is an offence.

  2. Ensure you have a record of all concerns that have been raised. Keep a copy of your written requests and any responses.

  3. Document how long it took your landlord or tenant to address your concerns.

Filing A Formal Complaint

If you cannot resolve the issue at hand, you will need to file a formal complaint with the Ministry of Municipal Affairs and Housing. You must provide:

  • your name and contact information

  • the name and contact information of the landlord or tenant involved in the dispute

  • details of the complaint

  • supporting documentation that is relevant to the conflict.

After Filing A Formal Complaint

Suppose the disagreement is an offence under the Residential Tenancies Act. In that case, the Ministry of Municipal Affairs and Housing will contact your landlord or tenant on your behalf to try to resolve the dispute. They will then follow up to ensure the issue has been resolved. If the problem is not resolved, a formal investigation may be conducted, resulting in charges or fines.

It is vital to establish a clear communication channel and understanding between landlords and tenants to minimize disagreements and ensure a pleasurable tenancy for all.
